Proving My Innocence

I have never been one of those people who runs with the wrong crowd, but about six months ago, I knew that I was in trouble. I was with someone when she did something against the law, and it made me a suspected accomplice. I knew that I needed help to prove my innocence regarding the involvement, so I started going through and talking with different criminal attorneys. What Happens After A DUI Arrest?

Your DUI (driving under the influence) case can go in several different directions after an arrest. The worst possible outcome, which is being sentenced to the maximum penalties, can be avoided if you are smart about your defense. Read on and learn what possible options exist for those arrested for DUI. 

Plea Bargains

Quite a lot of crimes are pled down using a plea bargain including a DUI. Tread carefully if you are offered a plea bargain by the state. This is a good time to contact a criminal defense lawyer if you don't already have one. They can inspect the evidence gathered against you and advise you on what to do. For example, if the state has a lot of evidence showing that you were legally intoxicated while driving, you should probably accept the plea bargain and be happy with it. However, a plea deal that is not much of a deal can be negotiated, particularly if the evidence is weak and would not stand up in a trial.

Charges Get Dropped

Some lucky defendants can find their charges dropped once their lawyer gets involved. This situation can occur when the evidence is examined, and something is amiss. The state knows you have a lawyer, and they cannot afford to put on a trial that they are unlikely to win. Also, some defendants can have their DUI charges dropped, but a plea bargain can be used to charge the defendant with reckless driving or the like rather than DUI.

Dealing With Your Driver's License

One of the worst situations caused by a DUI is that you may find your driver's license suspended pending the outcome of the case. If you are convicted of DUI, you might find your license suspended for several months. Most people cannot get along without driving their vehicle to work and other places so this becomes a major issue. Your driving privileges are a legal matter and are up to the department of motor vehicles (DMV) in your state. The DMV may suspend your license and it can take a court order to get it back. However, you may be eligible for a hardship license in the meantime. This license allows defendants to drive to work and certain other places for a limited time. This sort of license is not automatic and not everyone can get one.
